The Administration of Criminal Justice Act (ACJA) 2015 is a landmark legislation that aims to reform the criminal justice system in Nigeria. The ACJA 2015 provides for the administration of criminal justice and for related matters in the courts of the Federal Capital Territory and other Federal Courts in Nigeria. The ACJA 2015 repeals the Criminal Procedure Act (CPA) and the Criminal Procedure (Northern States) Act, which applied in the South and the North respectively, and harmonizes the criminal procedure rules in Nigeria.

The ACJA 2015 introduces many innovations and best practices that are intended to enhance the efficiency and effectiveness of the criminal justice system, protect the rights and interests of the suspects, defendants and victims, and promote speedy dispensation of justice. Some of the key features of the ACJA 2015 include:



  • The establishment of a Central Criminal Records Registry to record all arrests and criminal cases in Nigeria.



  • The requirement for the police to notify a suspect of the cause of arrest and his or her rights, including the right to remain silent, the right to legal representation, and the right to inform a relative or friend of the arrest.



  • The prohibition of arrest in lieu of another person or for a civil wrong or breach of contract.



  • The provision for bail as a right for any suspect arrested without a warrant, except for capital offences or other serious offences as specified by law.



  • The obligation for the police to report quarterly to the Attorney-General on all arrests made with or without warrant.



  • The duty of the Chief Magistrate to visit police stations every month and inspect the treatment and condition of suspects in custody.



  • The regulation of plea bargain and plea of guilty with adequate safeguards to prevent abuse and ensure transparency.



  • The introduction of electronic recording of confessions and statements of suspects, defendants and witnesses.



  • The provision for witness protection program and victim support services.



  • The limitation of adjournments to not more than five times for each party in any criminal trial.



  • The imposition of fines or costs on parties or counsel for frivolous applications or delays.



  • The empowerment of courts to order restitution, compensation or forfeiture as part of sentencing.



  • The creation of a special fund for victims of crime.




The ACJA 2015 is a comprehensive and progressive legislation that has been widely applauded by various stakeholders in the criminal justice sector. The ACJA 2015 is expected to address many of the challenges and problems that have plagued the administration of criminal justice in Nigeria for decades. However, the success of the ACJA 2015 depends largely on its effective implementation and enforcement by all relevant agencies and actors. Therefore, there is a need for continuous advocacy, sensitization, training and monitoring to ensure that the ACJA 2015 is fully operationalized and realized.
